Lite DePalma Greenberg was one of two law firms that prosecuted a Section 11 Securities Act class action against Prudential Financial and underwriters stemming from Prudential’s participation in the auction rate securities market, after that market collapsed in early 2008. The United States District Court for the District of New Jersey granted final approval to a nationwide settlement of $16.5 million.
Lite DePalma Greenberg served as the court-appointed discovery chair in an ERISA class action brought against Merck on behalf of its current and former employees who were participants in certain of Merck’s retirement plans. This complex ERISA case charged the fiduciaries of the plans with breaches of fiduciary duty. After many years of intense litigation, the United States District Court for the District of New Jersey approved a nationwide settlement worth $49,500,000.

Victor A. Afanador successfully persuaded the United States District Court for the District of New Jersey to issue an Ex Parte Order to Show Cause on an emergency basis for the benefit of an Lite DePalma Greenberg corporate client whose faithless employee was misappropriating corporate funds. With the assistance of the United States Marshals Service, Lite DePalma Greenberg quickly seized electronic and hard copy evidence from the defendants office in another state. Lite DePalma Greenberg’s efforts led to an immediate and complete victory for the firm’s client, as the defendant agreed to leave the company and transfer his equity interest back to Lite DePalma Greenberg’s client.
Lite DePalma announces final approval of a $1.3 million partial settlement in the nationwide securities fraud class action against Atlas Mining, Inc. Lite DePalma Greenberg serves as sole Lead Counsel for the Class. The partial settlement is with Atlas Mining, Inc., NanoClay and Technologies, Inc. and the individual defendants, and was reached after over two years of litigation in the United States District Court for the District of Idaho. Litigation against the Company’s auditor is currently ongoing.
